K\u0131dem tazminat\u0131 nas\u0131l hesaplan\u0131r? <\/h2>\n\n\n\n

\u0130\u015f s\u00f6zle\u015fmesinin k\u0131dem tazminat\u0131n\u0131 gerektiren bir nedenle sona ermesi halinde \u00e7al\u0131\u015f\u0131lan her tam y\u0131l i\u00e7in 30 g\u00fcnl\u00fck br\u00fct \u00fccret tutar\u0131nda k\u0131dem tazminat\u0131 \u00f6denmektedir. Bir y\u0131ldan artan s\u00fcreler de oranlanarak hesaplamaya dahil edilmektedir. 4857 say\u0131l\u0131 \u0130\u015f Kanununun 24 ve 25 inci maddelerinde g\u00f6sterilen ahlak ve iyi niyet kurallar\u0131na uymayan hallere dayanarak i\u015f\u00e7i veya i\u015fveren i\u00e7in tan\u0131nm\u0131\u015f olan s\u00f6zle\u015fmeyi fesih yetkisi, iki taraftan birinin bu \u00e7e\u015fit davran\u0131\u015flarda bulundu\u011funu di\u011fer taraf\u0131n \u00f6\u011frendi\u011fi g\u00fcnden ba\u015flayarak alt\u0131 i\u015fg\u00fcn\u00fc ge\u00e7tikten ve her halde fiilin ger\u00e7ekle\u015fmesinden itibaren 1 y\u0131l sonra kullan\u0131lamaz. Haftal\u0131k 45 saati a\u015fan \u00e7al\u0131\u015fmalar fazla \u00e7al\u0131\u015fma olarak de\u011ferlendirilmektedir. \u00c7al\u0131\u015fma s\u00fcresinin hesab\u0131 s\u0131ras\u0131nda i\u015f\u00e7ilere verilen ara dinlenme s\u00fcreleri (yemek molalar\u0131, \u00e7ay molalar\u0131 vb.) dikkate al\u0131nmamaktad\u0131r.<\/p>\n\n\n\n
