  8. Kirac\u0131, kat malikleri kurulunca kendisine tebli\u011f edilen hususlar\u0131, kiralayana haber vermek zorundad\u0131r.<\/li>\n

Kirac\u0131 y\u00f6netim plan\u0131, i\u015fletme plan\u0131, site \/bina y\u00f6netim kurulu kararlar\u0131, kat malikleri kurulu kararlar\u0131 ve sair d\u00fczenlemeler gibi t\u00fcm kurallara uymakla y\u00fck\u00fcml\u00fcd\u00fcr. Kirac\u0131n\u0131n bu kurallara uymamas\u0131 fesih ve tahliye nedenidir.<\/li>\n
  10. Kirac\u0131, kiralanandaki onar\u0131mlara katlanmak ve kiralanandaki ola\u011fan kullan\u0131mdan dolay\u0131 yap\u0131lmas\u0131 gereken onar\u0131mlar\u0131 yapmak\/yapt\u0131rmak ve giderlerini kar\u015f\u0131lamak zorundad\u0131r.<\/li>\n
  11. Kiralanan\u0131n m\u00fclkiyet hakk\u0131ndan do\u011fan vergileri kiralayana, kullan\u0131mdan do\u011fan vergi, resim, har\u00e7, kap\u0131c\u0131\/kaloriferci, bina aidat, yak\u0131t ve genel giderleri ile \u00e7evre temizlik vergileri ve giderleri kirac\u0131ya aittir. Uyu\u015fmazl\u0131k halinde, yerel \u00f6rf ve \u00e2detler uygulan\u0131r.<\/li>\n
  12. Kirac\u0131, kira s\u00f6zle\u015fmesinin sonunda, kiralanan\u0131 ald\u0131\u011f\u0131 \u015fekilde, kiralayana teslim etmek zorundad\u0131r: Keza kiralananla birlikte teslim edilen demirba\u015flar da al\u0131nd\u0131\u011f\u0131 \u015fekilde, kiralanana teslim edilmedi\u011fi takdirde, olu\u015fan hasarlar\u0131n bedelinin kiralayana \u00f6denmesi veya eski hale getirilmesi zorunludur.<\/li>\n
  13. Kirac\u0131, kiralanan\u0131n ola\u011fan kullan\u0131m\u0131 sonucu kiralanan\u0131n y\u0131pranmas\u0131ndan da sorumludur. Bu ifadeden kirac\u0131n\u0131n, kira ili\u015fkisinin bitimiyle beraber ola\u011fan y\u0131pranmalar\u0131 giderece\u011fi ve kiralanan\u0131 ne \u015fekilde teslim alm\u0131\u015fsa o \u015fekilde kiraya verene geri teslim edece\u011fi anla\u015f\u0131l\u0131r.<\/li>\n
  14. Kiralanan\u0131n iyi ve kullan\u0131lmaya elveri\u015fli halde teslim edildi\u011fi as\u0131ld\u0131r. Aksi durum kirac\u0131 taraf\u0131ndan ispatlanmak zorundad\u0131r.<\/li>\n
  15. Kirac\u0131, kira s\u00f6zle\u015fmesinin sona ermesi veya sat\u0131l\u0131\u011fa \u00e7\u0131kart\u0131lmas\u0131 halinde, kiralanan\u0131n gezilmesine ve incelenmesine izin vermek zorundad\u0131r.<\/li>\n
  16. Kiralanan\u0131n bo\u015falt\u0131lmas\u0131\/tahliyesi gerekti\u011fi hallerde, kiralanan\u0131n bo\u015falt\u0131lmamas\u0131 durumunda ortaya \u00e7\u0131kacak zararlardan dolay\u0131 kirac\u0131 sorumlu olacakt\u0131r.<\/li>\n
  17. Kirac\u0131, kendisi veya birlikte oturanlar\u0131n sa\u011fl\u0131\u011f\u0131 i\u00e7in ciddi tehlike olu\u015fturmayan kusurlardan dolay\u0131, kiralanan\u0131teslim almaktan ka\u00e7\u0131namaz, s\u00f6zle\u015fmeyi bozamaz ve kiradan indirim talebinde bulunamaz.<\/li>\n

Kirac\u0131, kiralanana yapt\u0131\u011f\u0131 faydal\u0131 ve l\u00fcks \u015feylerin bedelini kiralayandan isteyemez ve s\u00f6zle\u015fme bitiminde bunlar\u0131 kiralayandan kiradan d\u00fc\u015fme talebinde bulunamaz. S\u00f6k\u00fclmeden kaynakl\u0131 zarar\u0131 da kirac\u0131 kar\u015f\u0131lamakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/li>\n
  19. Kirac\u0131, kiralayan\u0131n yaz\u0131l\u0131 olurunu almak ve giderleri kendisine ait olmak \u00fczere, genel anten, uydu anteni, kablo televizyon gibi donan\u0131mlar\u0131 yapt\u0131rabilir.<\/li>\n<\/ol>\n

                                          S\u00f6zle\u015fme konusu i\u015fin tamamlanmas\u0131ndan sonra y\u00fcklenici s\u00f6zle\u015fmeye konu yap\u0131 ve i\u015fbu yap\u0131n\u0131n bulundu\u011fu yer i\u00e7erisinde fazla malzeme ve yapm\u0131\u015f oldu\u011fu faaliyete ili\u015fkin kal\u0131nt\u0131lar\u0131n\u0131 kald\u0131rmak, kurmu\u015f oldu\u011fu ge\u00e7ici yap\u0131lar\u0131 s\u00f6kerek i\u015f yerini temizlemekle y\u00fck\u00fcml\u00fcd\u00fcr.                                           Simsar\u0131n \u00fccrete hak kazanabilmesi i\u00e7in, sat\u0131c\u0131 ile bulu\u015fturdu\u011fu al\u0131c\u0131 ki\u015fi veya kurumun kimli\u011fi hususunda ve yapm\u0131\u015f oldu\u011fu simsarl\u0131k faaliyeti neticesinde al\u0131c\u0131y\u0131 sat\u0131c\u0131 ile bulu\u015fturdu\u011fu noktas\u0131nda sat\u0131c\u0131 ile mutab\u0131k kalmal\u0131d\u0131r. \u0130\u015fbu mutabakat\u0131n ge\u00e7erlili\u011fi sat\u0131c\u0131 ve simsar\u0131n yaz\u0131l\u0131 \u015fekilde m\u00fc\u015fterek irade uyu\u015fmas\u0131 ile m\u00fcmk\u00fcnd\u00fcr. Ancak simsar, her hal\u00fckarda i\u015fbu s\u00f6zle\u015fmenin akdedildi\u011fi tarihten \u00f6nceki mevcut ticari ili\u015fkiler i\u00e7in simsarl\u0131k \u00fccreti talep edemez.<\/p>\n

                                          \u00dccret ile ilgili do\u011fabilecek KDV dahil her t\u00fcrl\u00fc vergi, resim ve har\u00e7tan sat\u0131c\u0131 sorumludur.<\/p>\n

                                          S\u00f6zle\u015fmenin simsar taraf\u0131ndan hakl\u0131 bir sebep olmaks\u0131z\u0131n …….. y\u0131ll\u0131k s\u00fcreden \u00f6nce feshedilmesi halinde simsar herhangi bir \u00fccrete hak kazanamaz. Ayr\u0131ca simsar, i\u015f sahibinin u\u011frad\u0131\u011f\u0131 veya u\u011frayaca\u011f\u0131 do\u011frudan veya dolayl\u0131 zararlar\u0131n\u0131 da tazmin eder.<\/p>\n

                                          VII. Cezai \u015eart<\/strong><\/p>\n

                                          Simsar i\u015fbu s\u00f6zle\u015fmede belirtilen y\u00fck\u00fcml\u00fcl\u00fcklerinden herhangi birine ayk\u0131r\u0131 hareket ederse her bir ihlal i\u00e7in Sat\u0131c\u0131ya net \u2026\u2026\u2026 TL tutar\u0131nda cezai \u015fart \u00f6demeyi kabul , beyan ve taahh\u00fct eder. Sat\u0131c\u0131n\u0131n i\u015fbu cezai \u015fart\u0131n \u00fczerinde bir zarar\u0131 varsa\u00a0 u\u011fram\u0131\u015f oldu\u011fu zarar\u0131 ayr\u0131ca talep etmesi m\u00fcmk\u00fcnd\u00fcr.<\/p>\n

                                          VIII. Gizlilik Y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc, M\u00fcnhas\u0131rl\u0131k ve Rekabet Yasa\u011f\u0131<\/strong><\/p>\n

                                          Simsar kendine haz\u0131rlanan ortam ve ko\u015fullarda, gerekli bilgi ve belgeleri kullanarak, i\u015finin gere\u011fini yerine getirmekle y\u00fck\u00fcml\u00fcd\u00fcr. G\u00f6revini ifa s\u0131ras\u0131nda simsar, kendisine verilen ve \u00e7o\u011funlukla i\u015f sahibine ve m\u00fc\u015fterilere ait olan bilgi ve belgeleri i\u015f sahibi ve al\u0131c\u0131n\u0131n a\u00e7\u0131k r\u0131zas\u0131 olmadan 3. ger\u00e7ek ve\/veya t\u00fczel ki\u015filerle payla\u015fmayacakt\u0131r.<\/p>\n

                                          \u0130\u015f sahibinin veya al\u0131c\u0131n\u0131n r\u0131zas\u0131 haricinde s\u00f6zle\u015fmeye ayk\u0131r\u0131 olarak if\u015fa edildi\u011finin i\u015f sahibi ya da al\u0131c\u0131 taraf\u0131ndan \u00f6\u011frenilmesi halinde, simsar bundan dolay\u0131 s\u00f6zle\u015fme uyar\u0131nca sorumlu olacakt\u0131r.
